Minutes of August 6, 2008


Chairman Steve Hamilton called the meeting to order at 7:05 p.m. Present, in addition to the chairman, were members Michelle Degree, Dave Jakway, Keith Martin, Ann Sweet, and Bob Switzer. Absent was Joe Fitzpatrick. Cheryl Labadie represented the selectmen. Also present were Kathy Schillemat, Chairman of the Nelson Planning Board, Troy Tucker of that board, and Eric White of Sullivan.

Minutes of the meeting of July 2, 2008, were approved as distributed.

Questions about the legality of the Riesenberg subdivision
Chairman Hamilton passed around copies of a letter from the Sullivan Selectmen to the Nelson Planning Board and two letters from Sullivan Town Attorney regarding the incompleteness of the process by which the Nelson Planning Board had approved a subdivision of property belonging to the Riesenbergs that straddles the town line between Nelson and Sullivan. Chairman Hamilton reiterated the legal requirement (RSA 674:53.IV) that subdivision approval be sought from the Planning Board of Sullivan, as well as the Planning Board of Nelson. Mrs. Schillemat declared that the Nelson Planning Board wanted to correct the errors and promised to write to the Riesenbergs reiterating the requirements of RSA 674.l53.IV and declaring the Nelson Planning Board’s willingness to hold a joint hearing (as allowed by law) with the Sullivan Planning Board to consider a proposed subdivision of the Riesenberg property. Should the Riesenbergs refuse and begin activity on the property, the Town of Sullivan will have to issue a Cease and Desist order. Mrs. Schillemat asked to have a copy of the minutes of the August 6 meeting when prepared. Mr. White asked about the status of the Goodine property. On the assumption that the town line had created a separate property, Mr. Goodine had received a building permit. Several persons thought that, as long as no attempt was made to act as though the Nelson section of the original 200+ acres had been subdivided, the Goodine construction could proceed. However, no one was certain. Chairman Hamilton thanked Mr. White for pointing out the legal tangle. Mrs. Schillemat stated that the Nelson Planning Board had learned a great deal from the procedural snarl. Chairman Hamilton said that as volunteers, board members are learning all the time.


The Planning and Zoning Conference will be held October 25. Details will come.

Staff from SWRPC will make a presentation to the selectmen about brownfields and comprehensive economic planning at the selectmen’s meeting August 18, and planning board members are urged to attend at 7 p.m.

Nominations for Municipal Volunteer of the Year are sought.

Csenge need for Site Plan Review
Mrs. Labadie reported that Mr. Csenge continues to refuse to come to the planning board for site plan approval, despite the fact that since 2002, when he was first told SPR would be required, he has started new businesses, a requirement for SPR. Chairman Hamilton said the issue was in the hands of the selectmen.

Hearing on amendments to the subdivision regulations.
Amendments approved by the planning board last spring will be presented to the public for comment at the next regular meeting of the planning board, September 3.
