Minutes of February 6, 2008

Chairman Steve Hamilton called the meeting to order at 7:00 p.m. Present were members Michelle Degree, Joe Fitzpatrick, Dave Jakway, Ann Sweet, and Bob Switzer. Absent was Keith Martin. Rick Hotchkiss represented the selectmen. Kevin and Janice Dean were also present. 

Minutes of the meeting of January 2, 2008, were accepted as distributed.

Hearing on completeness of the application
The plat was reviewed for compliance with the check list, and the state subdivision approval was still missing. A motion (Hotchkiss/Switzer) to accept the application as complete conditionally until the state approval is presented passed without dissent.
Hearing on merits of the application
Mrs. Sweet noted the disparity between the earlier plat and the current one with regard to the acreage remaining in the property following the subdivision. She had tried to reach the surveyor with the question, but he had not returned her two phone calls. However, the acreage had been changed from about 38 acres remaining to 44 acres remaining. Mr. Hotchkiss pointed out that the number of acres outside the subdivision was not pertinent, although it would be preferable to have accurate information. Mr. Dean said he could not afford to have a survey of his remaining acreage at this time. The difference of 6 acres relates to an unresolved misunderstanding between the Deans and Dick Woodbury about ownership of 6 acres. There being no public present to ask questions, a motion (Jakway/Fitzpatrick) to approve the proposed subdivision with the condition of the receipt of the state subdivision approval passed without dissent. A motion (Fitzpatrick/Hotchkiss) made to set the boundary walk, after receipt of the state subdivision approval, at the March meeting passed without dissent. 

Announcements
ZBA hearing on Feb. 19 to consider a request for special exception requested by Dale Paquette to run a wood processing business. Questions were raised about the authority of the ZBA to permit travel over two private rights of way. Questions were also asked about the apparent failure of Mr. Paquette to comply with the selectmen’s Cease and Desist order. Mr. Hotchkiss said the hearing was close enough to the C&D deadline that the selectmen would wait until the decision. 

ZBA hearing on Feb. 26 to consider a request for special exception by Dennis and Elsie LaVanture to conduct sand excavation on their property on Corey Mine Road in two phases over several years. Annual spring planning board conference will be held April 26. 

Question to research
Is a formal survey required for either a boundary line adjustment or a voluntary merger? Next meeting: review possible changes to subdivision regulations, site plan review regulations, and driveway regulations
