Minutes of the Meeting of November 4, 2009

Chairman Bob Switzer called the meeting to order at 7:00 p.m. Present, in addition to the chairman, were members  Michele Degree, Laura Lewandowski,  and Ann Sweet.  Absent were members Barry Grass,  Dave Jakway, and Selectmen‘s representative Cheryl Labadie.

Minutes of the meeting of October 7, 2009, were accepted as distributed.

Chairman Switzer asked for member business, as there was no public business.

Energy Committee
Mrs. Sweet announced that Sullivan’s application for a building audit had been accepted by the NH Municipal Energy Assistance Program.  A company doing audits is expected to visit Sullivan’s four town buildings, choose the most likely for an audit, and make a presentation to the selectmen.  No dates yet.

Municipal Law Lectures
Mrs. Sweet reported that the NC Local Government Center booklet she borrowed reviews the evolving judicial interpretations of the state criteria for granting of variances to the zoning bylaw by the Zoning Board of Appeals.  Legislation approved in July will take effect January 1, 2010, defining “unnecessary hardship”:   “an unnecessary hardship will be deemed to exist if, and only if, owing to special conditions of the property that distinguish it from other properties in the area, the property cannot be reasonably used in strict conformance with the ordinance, and a variance is therefore necessary to enable a reasonable use of it.”  Of course, the first four criteria must all be met first.

There being no further business, the meeting adjourned at 7:20 p.m.
