Meeting Minutes of July 20, 2009

Meeting was called to order at 7:30 p.m.

Selectmen Present: Cheryl Labadie and Mark Paquette.

Payroll and bills were approved.

Mary Pinkham-Langer, Gravel Tax Appraiser for the NH Dept. of Revenue visited the LaVanture property on July 17, 2009. Regardless of the amount of sand removed from the property and whether it is taxable or not, an excavation permit is required (RSA 155-E). In Sullivan, a special exception from the Zonging Board must be granted before applying to the planning Board for the excavation permit. The LaVantures were denied a special exception and do not have an excavation permit. Therefore, they should not be removing any earth material for thier property. A letter will be sent to the LaVantures from Mary Pinkham-Langer and a copy will be sent to the Selectmen and Planning Baord. Further, the parcel from which the sand was removed is classified as "Current Use". Since a portion of the land has been altered, that portion (Approx 1/4 acre) no longer qualifies for current use classification and a current use penalty will need to be issued. Avitar will review the information and determine a value for the land (Penalty is 10% of the value).

Dennis and Elsie LaVanture were present. They wanted to know what to do next. They did not know that Mary Pinkham-Langer entered their property. They also wanted to know who contacted Mary Pinkham-Langer. They have contacted the State; they have given them an application, which says that they can remove up to 1000 yards of sand from their property, per year. They have also contacted their lawyer. Cheryl will look into what needs to be done now. Cheryl has all the information that the LaVantures have. Cheryl will call the town attorney for advice on what to do next.

Resident Present: Joanne Lincoln has concerns about her neighbors adding on to their garage. It is only 12 feet from her property. They have no building permit. There was a discussion about this problem. Cheryl will check into this  matter.

Zoning Board update; Rick Hotchkiss and Steve Hamilton have agreed to serve as members. Three additonal members are needed. Fawn is still waiting to hear from the planning Board and Conservation Commission members as to their willingness to serve. Fawn will prepare letters of appointment for the next Monday Meeting.

The Energy Committe has planned a walk through of the Town Hall on Monday July 27th at 7:00 p.m. in order to make a preliminary assessment of energy.
